I'm not sure that's the case - sounds like we haven't got the football share yet, but being able to keep the same name is one battle won.

We are probably classed as a new club with the old name it really wouldn't surprise me. This whole saga has had make it up as you go along written all over it.

Probably not allowed to enter cups still, but I guess we wait and see!

Well Craig has just tweeted me saying that their are no hidden agendas in regards to the name, he says it is down to the fa and the Durham fa. I am hoping he will elaborate a little more.

Yeah apparently they had a discussion and agreed it was better for both parties if the name stayed the same. This says to me that they are treating us as the continuing club now so why are we still being sanctioned. I know we don't have rajs share but we are still the same club !!

Compromise coming up? Stay in the Northern League due to ground limitations but be allowed entry into the FA Cup and FA Vase? I hope this is the start of a good bank holiday weekend!!

Well I asked him on twitter if we had sacrificed the cups this year for our name and he said no the fa just decided we could keep the name. So maybe they have realised they have been C**** to us and decided to be nice for a change.

Allowing us the name to stay is probably to justify how we are allowed to play next season maybe?

Yeah. I can't see the FA budging on that one very easily. I can just about deal with the northern league, and lack of cup competitions. But if we'd lost our name it would have been soul destroying after everything we've been through to save it. Probably sounds silly, but that's how I feel! :lol:

He didn't answer my final question which was " so does that mean the fa regard us a continuation of our club or do they still regard us as a newco"
But I took that to mean that we are still looked at as a newco, but we are still Darlington fc and we aren't dead, we have bought the club we are just a new company with a new footballing licence.

Even being a new entity, it's still the same company that owns 50% of the clauses, licence or no licence

I think we'll be fine on the clause we bought the assets and the rights to Darlington Football Club which is who the payments are due to. They weren't due to DFC 2009.

That's just business.

Where we fall foul with the FA is that new football share = new club. I can't see the football share we hold impacting any future due transfer fees.

The decision has probably been taken as a gesture of goodwill from the FA since we did actually pay the players. The fact that no share was transferred will put the kibosh on us being placed higher up the leagues on appeal tho I reckon. The FA will feel that they've been helpful now and if we play the "we paid our football related debts" they'll probably counter with "we let you keep your name"

Also use the "we even let you play next season even though you did not apply before 31st March as a newco"

I think the football share is a red herring.

Coming out of Admin with no CVA / financial restructuring mid season are both big no-no's now in the FA.

Playing in the FA Cup? yes we maybe could if they accept we are ultimately the same Club that applied.
